ECOSISTEMAS DEL PERÚ SESIÓN N° 10.

DISPOSITIVOS DE LEY Y NORMAS RELACIONADOS CON LA ECOLOGÍA.

1. Generalidades.

Los países del mundo cuentan con diversas normas de protección al sistema ecológico. Su protección es compleja. La ecología regula la naturaleza y la noción del hábitat del hombre. Si es así, entonces porque hay tanto atentado a la naturaleza.

En el Sistema Jurídico Peruano proliferan normas de diferente rango jerárquico, inclusive con diversas denominaciones al interior de un mismo rango.

Esta jerarquía pretende asegurar lo preeminencia de algunas normas por encima de otras en función al Poder del Estado que las crea.

2. NORMAS Y LEYES QUE PROTEGEN LA ECOLOGÍA

a. La Constitución.

b. Normas Internacionales.

c. El Derecho Penal – Código Penal.

d. Decretos Legislativos: Norma jurídica con rango de ley que emana del poder Ejecutivo por delegación expresa del poder Legislativo ( artículo de nuestra Constitución.

e. Decretos Leyes: Norma con rango de ley emanada del poder ejecutivo, sin intervención o autorización previa de un Congreso o Parlamento.

4. CONSTITUCIÓN POLÍTICA.

5. DECRETO LEGISLATIVO 757

LEY MARCO PARA EL CRECIMIENTO DE LA INVERSIÓN PRIVADA.

a. Crea incentivos a las Empresas Privadas.

b. Garantiza la debida Seguridad Jurídica.

c. Tienen participación los Gobiernos Regionales y Locales.

d. Faculta a cada sector a establecer los niveles de tolerancia de contaminación o deterioro del Medio Ambiente.

6. LEY DE CREACIÓN DEL CONSEJO NACIONAL DEL AMBIENTE LEY Nº 26410 MODIFICADA POR LA LEY 28245.

a. Crea el Consejo Nacional del Ambiente (CONAM).

b. El CONAM:

i. Dirige la Política Nacional Ambiental.

ii. SUPERVISA el cumplimiento de las Normas y Directivas otorgadas.

iii. Emite opinión en Materia Ambiental.

iv. Demanda el inicio de Acciones Administrativas, Civiles o Penales.

v. Fomenta la investigación.

7. LEY MARCO DEL SISTEMA NACIONAL DE GESTIÓN AMBIENTAL Nº 28245 (08.06.2004)

a. Busca asegurar el cumplimiento de los objetivos ambientales.

b. Establece coordinación entre las entidades sectoriales, regionales y locales.

c. Modificó el Art. 4º de la Ley 26410 otorgando mayores funciones al CONAM.

d. Adicionó el inicio “D” al Art. 5º de la Ley 26410 señalando el CONAM está integrado además por un órgano denominado tribunal de solución de controversias ambientales.

8. EL CÓDIGO PENAL

Busca:

a. Proteger el Medio Ambiente.

b. Las sanciones penales son preventivas y sancionadoras.

c. Adelantarse a la comisión de un daño, no permitiendo esperar la destrucción para recién reaccionar, por lo que protege la puesta en peligro.

d. Delitos contra los Recursos Naturales y el Medio Ambiente.

e. Arts. 304º al 314º

f. Delito Ecológico: Actos que atentan, dañan, perjudican o destruyen Recursos Naturales o contaminan el ambiente.

g. BIEN JURÍDICO: Medio Ambiente Natural.

Protección del suelo, agua, aire, flora, fauna.

Conservación de las especies.

h. TIPOS OBJETIVOS

SUJETO ACTIVO: Dependiendo del delito:

1. Personas Naturales:

· Funcionario Público.

· Servidor Público.

· Cualquier Persona.

2. Personas Jurídicas:

SUJETO PASIVO: La sociedad en general.

ACCCIÓN TÍPICA: Depende del tipo de delito.

SE SANCIONA PENALMENTE:

Contaminando (Vertiendo residuos sólidos, líquidos o gaseosos por encima de los límites establecidos. Art. 304º)

Art. 305º (Forma agravada)

El acto crea peligro para la salud: 2 a 4 años de PPL

El perjuicio catastrófico.

Se produce lesión grave o muerte: 3 a 6 ó de 4 a 8 PPL: PENA PRIVATIVA DE LIBERTAD.

Art. 306º

El funcionario público que otorga licencia de funcionamiento para cualquier actividad industrial a sabiendas que no se reúne los requisitos mínimos de protección al medio ambiente.

1 a 3 años de PPL:

Art. 307º

Deposita, comercializa, o vierte desechos industriales o domésticos en lugares no autorizados, sin cumplir las normas sanitarias. 2 años de PPL

Si se utilizan los desechos para alimentación de animales destinados al consumo humano. De 2 a 4 años de PPL.

Art. 307 - A

El ingresar al país residuos o desechos de un proceso de producción que originan desequilibrio ambiental.

De 1 a 3 años de PPL:

Art. 308º

Caza, captura, recolecta, extrae o comercializa flora o fauna protegida legalmente. De 1 a 3 años de PPL

Art. 309º

Extracción de flora o fauna acuática en época, cantidad y zona prohibida. De 1 a 1 años de PPL.

Art. 310º

Destruye, quema, daña o tala bosques o especies protegidas.

1 a 3 años de PPL.

AGRAVADA Si modifica el régimen climático.

Art. 311º

Uso de tierra agrícolas en actos de expansión urbana o extrae materiales de construcción. De 1 a 3 años de PPL

Art. 312º

El funcionario público que autoriza un proyecto de urbanización para actividad no conforme con los planes o usos legales. 2 años de PPL.

Art. 313º

Alteración del ambiente o paisaje natural, urbano o rural o modificar la flora o fauna.

2 años de PPL.

Art. 314º

MEDIDA CAUTELAR.

Suspensión de la actividad contaminante.

Clausura temporal o definitiva.

10. CONCLUSIONES.

a. Existe una diversidad de normas que se encuentran destinadas a proteger el medio ambiente, sin embargo, estas muchas veces, no son tomadas en cuenta, tanto por los entes administrativos como por los operadores judiciales.

b. Existe una gran variedad de Normas Generales, Específicas y Correlacionadas con el ámbito ambiental, las que han sido elaboradas desde el año 1942 a la fecha, destacándose su mayor producción a principios de los años 90 y en los últimos cinco años del presente siglo.

c. Dado que las normas han sido elaboradas en contextos de tiempo diferentes, no guardan necesariamente correlación entre ellas, en particular las elaboradas en los años de 1942 a principios de los años 90; sin embargo las emitidas en los últimos cinco años si enfrentan en términos generales el tema ambiental como un sistema

d. A pesar de la diversidad de dispositivos legales, no existe intensión política ni judicial de luchar eficientemente contra los depredadores.

e. Las sanciones penales establecidas, son en gran parte menores a los 04 años de PPL, lo que hace que no sea posible que los Jueces puedan ordenar la detención.

f. Que el mal uso de la Garantía Constitucional de la acción de Amparo, conlleva a permitir que los delincuentes sigan siendo favorecidos para poder continuar con sus actos nefastos.

g. Varias de las normas tienen que ser reevaluadas en relación a la vigencia de estas y en varios casos insertadas en sus conceptos fundamentales a otras normas que si están en vigencia.

h. La transectorialidad de las normas es un tema que debe ser enfrentado en forma sistémica ya que los diversos sectores emiten normas que tienen componentes de carácter ambiental, que colisionan con otras que ya están en vigencia

i. La Ausencia de una adecuada preparación profesional de los encargados de prevenir y supervisar a las empresas o personas que cometen hechos en agravio del medio ambiente, coadyuvan a generar un clima de impunidad.

j. La falta de material logístico, contribuye a la realización de una verdadera política de prevención.

RECOMENDACIONES

a. Formar a nivel Gobierno Central una Comisión de Alto Nivel, conformada en lo que se refiere a su conducción por un renombrado Ambientalista y en lo referido a sus componentes con representantes de todos los Sectores e Instituciones Estatales; así como con miembros de la Sociedad Civil, ONG y el empresariado para que en conjunto revisen toda la normatividad ambiental emitida y propongan las modificaciones que sean pertinentes desde un enfoque sistémico, realista y futurista, orientando entre otros tópicos, su revisión a aspectos considerados fundamentales tales como:

b. Se debe formar y capacitar a las personas encargadas de los temas ecológicos, a fin de que asuman un rol protagónico en de defensa del medio ambiente, así como implementar de material logístico suficiente, a efecto de realizar un trabajo acorde a las necesidades del sector.

c. La Ausencia de una adecuada preparación profesional de los encargados de prevenir y supervisar a las empresas o personas que cometen hechos en agravio del medio ambiente, coadyuvan a generar un clima de impunidad.

d. Las penas privativas de libertad señaladas en el Código Penal deben tener como tiempo mínimo el de cuatro años, a fin de que los jueces (siempre y cuando se reúnan los requisitos para ordenar la detención), puedan dictar la detención desde el auto apertorio de instrucción.

e. Deben crearse Fiscalías especializadas el Delitos ecológicos en todos los distritos judiciales, para lo cual el Gobierno central debe otorgar una partida específica para ese rubro.

DEVICES OF LAW AND RULES RELATING TO ECOLOGY.

1. General.

The countries of the world have different standards of protection to the ecological system. Their protection is complex. Ecology regulates the nature and the notion of the human habitat. If so, then why is there so much attack on nature.

In the Peruvian legal system different standards proliferate rank, even with different denominations within the same range.

This hierarchy is intended to ensure the preeminence of certain rules over others according to state power which created them.

2. RULES AND LAWS THAT PROTECT THE ECOLOGY.

a. The Constitution.

d. Legislative decrees: Rule of law with the force of law emanating from the executive branch by express delegation of legislative power (Article of our Constitution.

4. CONSTITUTION.

7. LAW UNDER THE NATIONAL ENVIRONMENTAL MANAGEMENT SYSTEM N º 28245 (08/06/2004)

a. Seeks to ensure compliance with environmental objectives.

c. Amended Article 4 of Law 26410 gave more functions to CONAM.

d. Added the start, "D" to Article 5 of Law 26410 is pointing CONAM integrated by a body called the court environmental dispute resolution.

Article 306 º

The public official operating license granted to any industrial activity, knowing that does not meet the minimum requirements of environmental protection.

1 to 3 years of PPL:

Art. 307 º

Deposits, sells, or industrial or domestic waste discharged in unauthorized places, without meeting sanitary standards. PPL 2 years

If waste is used to feed animals intended for human consumption. 2 to 4 years of PPL (custodial sentence).

Article 307 - A

Entering the country waste or scrap a production process that cause environmental imbalance.

1 to 3 years of PPL:

Article 308 º

Hunting, trapping, gathering, removed or sold legally protected flora or fauna. 1 to 3 years PPL (custodial sentence)

Article 309 º

Removing aquatic flora or fauna time, amount and the prohibited zone. 1 to 1 years of PPL (custodial sentence).

Destroyed, burned, damaged or logging forests or protected species.

10. CONCLUSIONS.

a. There are a variety of rules that are designed to protect the environment, however, these often are not taken into account, both administrative bodies and by the judicial.

b. There are a variety of general rules, specific and correlated with the environmental field, which have been developed since 1942 to date, highlighting their increased production in the early 90's and in the last five years of this century.

c. Since the rules have been developed in different time contexts, are not necessarily correlated between them, particularly those developed in the years from 1942 to early 90's, but those issued in the last five years if they face broadly environmental issues as a system.

d. Despite the diversity of legal devices, there is no judicial políticani intention to fight effectively against predators.

e. The criminal penalties established, are largely lower than the 04 years of PPL (custodial sentence), which makes it not possible that judges may order the arrest.

f. The misuse of the constitutional guarantee of the action of Amparo, leads to allow offenders to remain favored to continue their nefarious deeds.

g. Several of the rules have to be reassessed in relation to the validity of these and in some cases inserted into its fundamental concepts to other standards if they are in effect.

h. The cross of standards is an issue that must be addressed systemically because different sectors have issued standards of environmental components, colliding with others already in place

i. The absence of adequate professional training of managers to prevent and monitor the firms or individuals who commit acts to the detriment of the environment, contribute to a climate of impunity.

j. The lack of logistical, contributes to the achievement of an effective policy of prevention.

RECOMMENDATIONS

a. Join Central Government at a High Level Commission, made in regard to driving by a renowned environmentalist and with regard to its components with representatives of all State institutions and sectors, and members of Civil Society NGOs and business to jointly review all issued environmental regulations and propose changes that are relevant from a systemic approach, realistic and futuristic, directing among other topics, the review considered fundamental aspects such as:

b. Must educate and train those responsible for environment issues, to assume a leading role in defense of the environment, and implement adequate logistical equipment, in order to perform work according to the needs of the sector.

c. The absence of adequate professional training of managers to prevent and monitor the firms or individuals who commit acts to the detriment of the environment, contribute to a climate of impunity.

d. Custodial penalties outlined in the Penal Code should have the minimum time of four years, so that the judges (as long as they meet the conditions for ordering the arrest), may issue the arrest from the writ of inquiry .

e. Prosecutors should be created specialized environmental crime in all judicial districts, for which the central government must give a specific item for this area.
